You Can Call Your Boss Anything, If You Are Forming A Union



Court says it’s OK to call boss ‘nasty motherf–ker’ during union battle

Calling your boss a “nasty motherf–ker” is totally cool — as long as you’re trying to form a union.

A worker at a Chelsea Piers catering hall has won a Manhattan federal court ruling that said he had a legal right to drop an F-bomb on his supervisor in an angry Facebook rant because he and fellow employees were in the middle of a union battle.
Hernan Perez, who had worked at the waterfront venue Pier Sixty for 13 years, had filed a complaint with the National Labor Relations Board saying he’d been wrongly fired in 2011 for the social-media post.
He wrote the missive on Oct. 27 of that year, after a hard day’s work in which he furiously butted heads with his boss, Robert “Bob” McSweeney, according to court records.
“Bob is such a NASTY MOTHER F–KER don’t know how to talk to people!!!!!!” Perez wrote on Facebook during a break.
“F–k his mother and his entire f–king family!!!! What a LOSER!!!! Vote YES for the UNION!!!!!!!”
Pier Sixty caught wind of the post and fired Perez less than two weeks later.
He had tried calming the waters by deleting the post altogether, to no avail.
At the time, Perez and his co-workers were neck-deep in a unionization campaign, so he claimed in court that his Facebook rant had been specifically aimed at them in an attempt to form a union.
After an administrative law judge upheld Perez’s NLRB complaint, Pier Sixty appealed the ruling to the federal Second Circuit Court of Appeals.
On Friday, it upheld the lower court’s ruling. The Second Circuit Court said the comments involved union activity protected by the National Labor Relations Act, which covers all union-related speech that is not deemed too “opprobrious,” or scornful.
“Perez’s conduct sits at the outer‐bounds of protected, union‐-related comments,” the court wrote in its ruling.
While describing the reasoning behind their decision, the judges also cited employee testimony outlining the numerous expletives and racial slurs that Pier Sixty managers shouted at workers and tolerated on a daily basis, including: “What the f–k are you doing?,” “motherf–ker,” and “Are you guys f–king stupid?”
In addition, Pier Sixty had never terminated someone for swearing before in the past. Pier Sixty did not respond to a request for comment Monday.

Second Circuit Finds That Employee’s Obscene Facebook Post Is Protected Activity, Reminding Employers of the Importance of Uniformly Enforcing Employee Conduct Policies

In NLRB v. Pier Sixty, LLC, the Second Circuit held that an employee’s expletive-laden Facebook post – which hurled vulgar attacks at his manager, his manager’s mother and his family – did not result in the employee losing the protection of the National Labor Relations Act (“Act”). But even though the Second Circuit conferred protected status on this unquestionably obscene post, it did not create a protected right to level profane verbal assaults on management when discussing union business. Such conduct has been, and will continue to be, unprotected in most circumstances. Nevertheless, this case acts as an important reminder for employers: if they choose to allow vulgar conduct in the workplace when it does not pertain to union activity, they must also allow it when it does.

A Pier Sixty Employee Posted an Obscene, Pro-Union Facebook Message in Response to Management’s Alleged Disrespect

Pier Sixty operates a catering company in New York, New York. In 2011, its employees embarked on a tense organizing campaign during which management allegedly threatened employees with discipline for union activity, disparately enforced a no-talk rule and told employees “bargaining would start from scratch” if they voted to unionize. Two days before the election, Hernan Perez, a server employed by Pier Sixty, posted a vulgar Facebook message after his supervisor gave him instructions in a tone that Perez perceived to be disrespectful. That post read:

"Bob is such a NASTY [expletive] don’t know how to talk to people!!! [Expletive] his mother and his entire [expletive] family!!!! What a LOSER!!! Vote YES for the UNION."

The Facebook post was accessible by Perez’s Facebook friends, which included 10 coworkers, and by the public, although Perez insisted he did not know that at the time. Perez deleted the post three days later, but Pier Sixty management had already learned about it and, after conducting an investigation, terminated Perez.

Perez’s Facebook Post Constituted Protected Activity Because Pier Sixty Routinely Tolerated Similarly Profane Outbursts from Employees

The Second Circuit ultimately concluded that Perez’s Facebook post constituted protected activity because Pier Sixty routinely permitted vulgarities in the workplace. Notwithstanding the profane language, Perez’s post “explicitly protested” management’s mistreatment and “exhorted employees to ‘Vote YES,’” while Pier Sixty’s anti-union animus was uncontested. Given these circumstances, “the Board could reasonably determine that Perez’s outburst was not an idiosyncratic reaction to a manager’s request but part of a tense debate over managerial mistreatment in the period before the representation election.” Moreover, Pier Sixty consistently tolerated “widespread profanity in the workplace,” and both management and employees used “daily obscenities” without consequence. In the six years preceding Perez’s termination, there had only been five written warnings issued for such language and no terminations – until Perez. The Second Circuit noted that “it is striking that Perez – who had been a server at Pier Sixty for thirteen years – was fired for profanities two days before the Union election when no employee had ever before been sanctioned (much less fired) for profanity.”

The Second Circuit also found the manner in which Perez communicated his ire to be significant. Social media is a “key medium of communication among coworkers and a tool for organization in modern era,” and, despite publicly posting the message, Perez’s outburst did not occur “in the immediate presence of customers nor did it disrupt the catering event.” Thus, the Court found the post to be distinguishable from other “opprobrious conduct” cases it had considered.

Notably, although the Second Circuit deemed Perez’s post to be protected under the Act, it also cautioned, “this case seems to us to sit at the outer-bounds of protected, union-related comments, and any test for evaluating ‘opprobrious conduct’ must be sufficiently sensitive to employers’ legitimate disciplinary interests.”

Court Questioned the Validity of the Board’s “Totality of the Circumstances” Test

In 2012, the Second Circuit, in NLRB v. Starbucks, 679 F.3d 70 (2012), concluded that the test traditionally employed by the Board to assess whether obscenities uttered in the workplace constitute protected activity – the Atlantic Steel test – did not sufficiently accommodate employers’ legitimate interest in preventing employees’ public outbursts in the presence of customers and remanded the case to the Board to develop “more balanced standards for evaluating ‘opprobrious’ conduct in that context.” The Office of the General Counsel subsequently issued Memorandum OM 12-59, which set forth a nine-factor “totality of the circumstances” test to assess the protected nature of employees’ social media communications, which the Second Circuit characterized as “more employee-friendly.” The Board employed this test in Pier Sixty, LLC, but the Second Circuit questioned the test’s legitimacy, stating that “we are not convinced the amorphous ‘totality of the circumstances’ test adequately balances an employer’s interests…” Ultimately, though, because Pier Sixty did not object to it the Second Circuit applied the test – without sanctioning its validity.

Lessons Learned From Pier Sixty

This case serves as a reminder that employers must take the long view when deciding whether to discipline employees for workplace conduct that is inappropriate but not particularly offensive to the employer. Here, Perez’s posting would have likely fallen outside the bounds of protected activity had Pier Sixty disciplined employees for similar vulgarities in the workplace. However, because Pier Sixty routinely tolerated such conduct from management and employees alike, the Second Circuit could not find that Perez’s conduct was “so egregious as to exceed the NLRA’s protection.”

This case also signals that the Second Circuit, and perhaps other courts, may be willing to abandon the Board’s “totality of the circumstances” test in favor of a standard that better protects employer’s legitimate interests in regulating employees’ workplace conduct. Employers defending cases in which the Board employs this test should vigorously argue that this standard improperly intrudes upon their legitimate business interests.


The NLRB Says My Employee Can Call Me What?

Employers are often surprised by the extent to which the National Labor Relations Act (“NLRA”) protects intemperate, even abusive, outbursts by employees in connection with union matters or other workplace issues. While, in some instances, statements made by an employee may be deemed so obnoxious or disruptive as to forfeit the protections of the NLRA, employees generally enjoy a fair degree of latitude in criticizing their employer or its supervisors in connection with work-related issues of mutual concern to employees.

A recent decision by the U.S. Court of Appeals for the Second Circuit, NLRB v. Pier Sixty, LLC, affirming a ruling by the National Labor Relations Board (“NLRB”), illustrates this point. Both the NLRB and the Second Circuit concluded that an employee’s angry social media rant – which included obscenities directed toward his manager and the manager’s family – was protected under the NLRA, in large part because the employer had never previously fired or otherwise disciplined employees for using similar vulgarities.

As this decision underscores, employers should act with caution in terminating or otherwise disciplining employees for even seemingly outrageous statements that implicate union issues or other matters covered by the NLRA.
Background

In general, the NLRA gives both unionized and non-unionized employees a right to engage in “protected concerted activities” – that is, actions aimed at employees’ mutual aid and protection, and relating to the terms and conditions of their employment. An employer that discharges an employee for actions falling within this rubric can be ordered to reinstate the employee with back pay.

In recent years, the NLRB has shown a particular interest in safeguarding social media expression by employees related to their terms and conditions of employment. Many NLRB and court decisions, including the Pier Sixty case, have involved efforts to balance this principle against employers’ interests in maintaining respect and civility in the workplace.
A Problematic Facebook Post

Pier Sixty operates a catering company in New York City. In early 2011, many of the company’s service employees began seeking union representation. The organizing campaign, which ultimately resulted in the workers’ voting to unionize, was tense, with managers allegedly threatening to discharge or otherwise penalize employees for union-related activities.

Two days before the union representation election, Herman Perez (“Perez”), a longtime Pier Sixty employee, was working at a catering event when he and two other servers received directions from their supervisor, Robert McSweeney (“McSweeney”). Speaking in what the NLRB described as “harsh tones,” McSweeney ordered Perez and his co-workers to “turn [their] heads [towards the guests] and stop chitchatting,” and to “spread out, move, move!”

About 45 minutes later, during an authorized break from work, Perez posted the following message about McSweeney on Perez’s Facebook page:

Bob is such a NASTY [expletive] don’t know how to talk to people!!!!!! [Expletive] his mother and his entire [expletive] family!!!! What a LOSER!!!! Vote YES for the UNION!!!!!!!

Perez’s Facebook “friends,” ten of whom were co-workers, were able to view the post. The post was also publicly accessible, though Perez claimed not to have been aware of that fact. By the time Perez took down the post – three days later – management had become aware of what Perez had posted. Subsequently, the company conducted an investigation, which culminated in Perez’s termination.

In response to his termination, Perez filed a charge with the NLRB, alleging that he had been unlawfully fired for engaging in protected concerted activities. After a hearing, an NLRB administrative law judge concluded that Perez’s Facebook post had constituted protected activity, for which Perez was unlawfully terminated. A three-member NLRB panel affirmed the administrative law judge’s decision.

Subsequently, the NLRB asked the Second Circuit to enforce its decision, and Pier Sixty filed a cross-petition seeking to vacate the holding.
The Second Circuit’s Holding

In its decision, the Second Circuit noted that while the NLRA generally prohibits employers from taking adverse employment actions based on concerted activity – including social media communications among employees relating to terms and conditions of employment – otherwise protected activity may be so outrageous or extreme that it loses the protection of the NLRA. (The NLRB and the federal circuit courts have applied varying legal standards in determining when this line has been crossed.)

The Second Circuit concluded, however, that though Perez’s Facebook post was vulgar and offensive, it did not go beyond the pale of NLRA protection. The court cited a number of factors in support of this conclusion:



While Perez’s post included vulgar attacks on McSweeney and his family, it also referred directly to the impending union election.


Pier Sixty had consistently tolerated the use of obscenities by its employees, including the specific vulgarities used by Perez in his post. Since Pier Sixty had never disciplined – let alone discharged – any other employee solely for using obscenities, the NLRB had reasonable grounds for concluding that Perez would not have been terminated had his Facebook post occurred outside the context of the union election.


The forum Perez used for his comments – Facebook – has become a key medium of communication among coworkers and an important tool for union organizing.


Finally, while Perez’s Facebook post was visible to the public – including actual and potential Pier Sixty customers – his online comments were, nonetheless, distinguishable from an outburst occurring in front of customers attending a catering event.


The Second Circuit cautioned, however, that Perez’s activity fell on the “outer-bounds of protected, union-related comments.” Indeed, the court suggested in its decision that if Pier Sixty had had an established practice of disciplining employees for similarly obscene outbursts, its termination of Perez might have been upheld.
Implications For Employers

The Pier Sixty case provides some helpful reminders for employers. In particular, an employer should approach with caution any potential firing stemming from a social media posting by an employee pertaining to union or other workplace issues. The risk of any such firing increases when the post is viewable, commented on, “retweeted,” or “liked” by fellow employees, as this makes the concerted nature of the activity even more apparent.

Similarly, if an employer intends to discipline an employee for obscene or otherwise extreme statements related to workplace issues, the employer should consider whether it has previously disciplined employees for similar conduct unconnected to issues implicating the NLRA. Again, the fact that Pier Sixty had consistently tolerated similar vulgarities by employees in other contexts was a pivotal factor in the Second Circuit’s conclusion that Perez’s termination was unlawful.

The Court of Appeals and Probationary Teachers' Termination

 Getting tenure is not what it used to be.

Many years ago (I am not being deliberately vague, but there was no clear line drawn in the sand) teachers who were good at what they did whether it be physical education or physics or something else, could get tenure in three years.

Today, even if you are good at teaching, counseling or whatever, tenure may be four years away or never, depending on circumstances and/or administrative dislike or whim.

I am always saddened when an effective educator gets terminated before getting tenure. This termination should be fought, and fought hard. Most cases are brought within four months to the Supreme Court in the form of an Article 78. Another option is to file a Summons and Complaint in the Supreme Court. Either way, if you lose, you can file an Appeal to the First/Second/Third Appellate Division and if you lose there, you can ask to go to the Court of Appeals, the highest court in New York State.

These cases call upon us to decide whether petitioners Leslie Kahn and Doreen Nash (collectively, petitioners) were required to exhaust an available internal appeal procedure before challenging the termination of their probationary employment at the City of New York's Department of Education (the Department or DOE). The Department is obligated by its collective bargaining agreement (CBA) with the United Federation of Teachers and its own bylaws to afford probationary employees the opportunity for reconsideration of a decision to discontinue their employment.

We hold that DOE's decisions were "final and binding" within the meaning of CPLR 217 (1) as of the dates when Kahn's and Nash's probationary service ended, January 25, 2008 and July 15, 2005, respectively. Petitioners awaited the outcome of the internal reviews provided for under the CBA and DOE's bylaws before commencing suit. But these reviews "stem[] solely from the [CBA]" and constitute "an optional procedure under which a teacher may ask [DOE] to reconsider and reverse [its] initial decision, . . . which is final and which, when made, in all respects terminates the employment of a probationer under Education Law § 2573 (1) (a)" (Matter of Frasier v Board of Educ. of City School Dist. of City of N.Y., 71 NY2d 763, 767 [1988] [emphases added]); they are not administrative remedies that petitioners were required to exhaust before litigating the termination of their probationary employment. As a result, petitioners' lawsuits, brought more than four months after the dates when their probationary service ended, are time-barred.

I.

  Kahn

On February 1, 2005, Kahn began her three-year probationary period of employment at DOE as a social worker at the Williamsburg High School for Architecture and Design. In June 2007, she accepted a position as a social worker at Khalil Gibran International Academy. On December 17, 2007, Gibran's interim principal issued an observation report in which she evaluated Kahn's counseling session with students on December 12, 2007 as unsatisfactory. On December 19, 2007, the principal also rated Kahn's performance as unsatisfactory in an annual professional performance review, and recommended denial of completion of probation. Then on December 21, 2007, the community superintendent informed Kahn that, in accordance with Education Law § 2573 (1), she was denying her certification of completion of probation; that under the terms of the CBA between DOE and the bargaining unit of which Kahn was a member she was "entitled to the review procedures . . . prescribed" in article 4 of the Department's bylaws; and that her service pursuant to her appointment would "terminate as of close of business January 25, 2008."

Section 4.3.2 of DOE's bylaws (formerly section 5.3.4), entitled "Appeals re Discontinuance of Probationary Service" provides that

"[a]ny person in the employ of the City School District who appears before the Chancellor, or a committee designated by the Chancellor, concerning the discontinuance of service during the probationary term, or at the expiration thereof, shall have a review of the matter before a committee which shall be designated in accordance with contractual agreements covering employees or by regulations of the Chancellor, as appropriate.

"After the review, the committee shall forward its advisory recommendation to the community superintendent or to the Chancellor in accordance with contractual agreements."

Under section 4.3.3, the employee is entitled to appear in person at the hearing, accompanied by an advisor; to be confronted by and call witnesses; and to examine exhibits and introduce relevant evidence. The CBA calls for the section 4.3.2 review to be conducted by a tripartite committee of professional educators, with one selected by the teacher, one by DOE and the third by the other two from an agreed-upon list.

On January 3, 2008, Kahn initiated the section 4.3.2 review by notifying the Department's Office of Appeals and Reviews that she requested an appeal; she checked only the box labeled "Discontinuance" as a reason for her appeal.[1.This form letter stated simply "I hereby request an appeal for the following reason(s): Check appropriate category(ies)" and identified the following four choices: "U" Rating; C-31; C-31 and "U" Rating; and Discontinuance. C-31 apparently refers to Chancellor's Regulation C-31, which sets forth procedures to be followed to terminate New York City licenses of untenured pedagogical employees.]

The committee held a hearing on April 9, 2008. By a vote of 2-1, the committee recommended "non-concurrence" with the decision to discontinue Kahn's probationary service. The director of the Office of Appeals and Reviews forwarded the committee's confidential advisory report to the community superintendent on April 16, 2008, advising her to review the report and examine the record, and notify Kahn in writing of her decision either to reaffirm or reverse the discontinuance of Kahn's probationary service. On May 9, 2008, the superintendent informed Kahn that she "reaffirmed the previous action which resulted in Denial of Certification of Completion of Probation effective close of business on January 25, 2008."

On September 9, 2008, exactly four months later, Kahn commenced this CPLR article 78 proceeding against DOE, the Chancellor and the interim principal at Gibran (collectively, DOE). In her amended petition, dated November 17, 2008, Kahn claimed that the principal's observation of the counseling session was deficient because not "made in consultation with an 'in-discipline' Social Work Supervisor [possessing] a clinical license," as required by the CBA; and that the principal's deficient observation and inaccurate assessment of her record of attendance and punctuality caused DOE to terminate her employment, which also effectively barred her from any future job in the New York City school system.

Kahn alleged two "causes of action": that DOE failed to perform duties enjoined by law and acted in an arbitrary and capricious manner in violation of CPLR article 78; and that DOE violated the due process clauses of the federal and state constitutions and 42 USC § 1983 by "providing [Kahn] with an unsatisfactory rating and in terminating [her] in a manner that did not comport with fair processes."

She principally sought orders vacating DOE's decisions resulting in the unsatisfactory rating and termination of her employment; permitting her to "resume her status" as a probationary DOE employee; and directing that any further evaluations of her performance comply with the CBA's requirements governing her position.

On January 12, 2009, DOE cross-moved to dismiss the petition. The Department argued that Kahn's claims were precluded by her failure to file a notice of claim as required by Education Law § 3813 (1);[2. Section 3813 (1) of the Education Law states that
"[n]o action or special proceeding, for any cause whatever .
. . or claim against the district or any such school, or involving the rights or interests of any district or any such school shall be prosecuted or maintained against any school district, board of education . . . or any officer of a school district [or] board of education . . . unless it shall appear by and as an allegation in the complaint or necessary moving papers that a written verified claim upon which such action or special proceeding is founded was presented to the governing body of said district or school within three months after the accrual of such claim, and that the officer or body having the power to adjust or pay any said claim has refused to make an adjustment or payment thereof for thirty days after presentment."]

 that the proceeding was barred by expiration of CPLR 217 (1)'s four-month statute of limitations; that to the extent Kahn challenged her unsatisfactory rating, she had not exhausted her administrative remedies; and that her petition did not state a cause of action under section 1983 because she had not been deprived of any property or liberty interest.

Supreme Court denied DOE's cross motion in a decision and order dated September 8, 2009 (26 Misc 3d 366 [NY County 2009]). The judge ruled that because Kahn was seeking equitable relief rather than money damages, Education Law § 3813 (1) did not mandate a timely notice of claim as a prerequisite to her lawsuit (id. at 370-373); that her claims under section 1983 were timely and pleaded sufficiently to survive a motion to dismiss (id. at 380-383); and that "any failure by [Kahn] to exhaust any administrative remedies available in connection with the U- Rating" should be excused because "[t]o the extent the December 21 decision was made in partial reliance on the U-Rating, [Kahn] fully addressed the rating at the Chancellor's hearing regarding her termination" (id. at 381).

The bulk of Supreme Court's decision addressed what the judge called "the challenging issue of determining the precise reach" of Frasier. She acknowledged that the First and Second Departments had consistently interpreted Frasier to mean that "an Article 78 proceeding commenced by a probationary teacher more than four months after the discharge" was untimely (id. at 375, citing Matter of Schulman v Bd. of Educ. of the City of New York, 184 AD2d 643, 644 [2d Dept 1992] ["There is no merit to the petitioner's argument that the review of this administrative determination (to terminate his probationary employment) served to extend the four month limitations period"]; Matter of Strong v New YOrk City Dept. of Educ., 62 AD3d 592, 593 [1st Dept 2009] ["Petitioner's time to commence the (CPLR article 78) proceeding was not extended by her administrative appeal of (the) determination" to terminate her probationary employment as a per diem substitute teacher]; Matter of Triana v Bd. of Educ. of the City School Dist. of the City of New York, 47 AD3d 554, 557 [1st Dept 2008] ["The law is well established that a decision to terminate the employment of a probationary teacher is final and binding on the date the termination becomes effective, and this is true even in circumstances where administrative review is available"] [internal citations omitted];and Matter of Lipton v New York City Bd. of Educ., 284 AD2d 140, 140-41 [1st Dept 2001] ["Petitioner's claim that the termination of her probationary employment was invalid because she was, in fact, a tenured employee was properly dismissed on the ground that the instant CPLR article 78 proceeding was not brought within four months of (the Chancellor's) letter advising petitioner of the termination of her probationary employment"]).

But Supreme Court criticized these interpretations as based upon "no discussion at all," featuring "sweeping statement[s]" that imbued Frasier with "a meaning . . . never intended" by the Court of Appeals (26 Misc 3d at 375). The judge distinguished Frasier on the ground that it involved backpay rather than reinstatement, and did not mention CPLR 217 (1); she considered the appellate courts' interpretation of Frasier to create an anomaly because, in her view, "[t]he law [was] clear that an employee's appeal of a U-Rating, made with or without an appeal of a discontinuance, [would] stay the running of the statute of limitations as to the issue of the U-Rating" (id. at 378).

Further, the judge opined that "language in Frasier itself suggests" that we meant that decision to be "a limited one," not covering situations where there was "a statutory or constitutional violation or procedural defect" as is potentially the case here, where Kahn "assert[ed] a statutory violation in that she was denied 60 days' advance notice before her termination as required by Education Law § 2573 (1) (a),"

Kahn does not appear to mention the lack of 60 days' notice in her amended petition or motion papers. Where a probationary teacher or other member of the teaching staff is not recommended for tenure, the superintendent must issue written notice of that decision no later than 60 days before the probationary period (with exceptions, three years) ends (Education Law § 2573 [1] [a]). We have held that the remedy for noncompliance with this notice provision is "one day's pay for each day the notice was late" (Matter of Tucker v Board of Educ., Community School Dist. No. 10, 82 NY2d 274, 278 [1993]; see also Matter of Vetter v Board of Educ., Ravena-Coeymans-Selkirk Cent. School Dist., 14 NY3d 729 [2010]).]

and "also claim[ed] that her rights under the [CBA] were violated in that the Committee considered a U-Rating issued by the principal without the participation of a Social Work Supervisor" (id. at 379). While "respectfully urg[ing] the First Department to take a second look at Frasier" (id. at 373), Supreme Court concluded Appeals of unsatisfactory ratings are governed by section 4.3.1 of DOE's bylaws. This provision, which is not worded the same as section 4.3.2, specifies that the committee's findings and recommendations "shall be submitted to the Chancellor for a final decision." 

that Kahn's CPLR article 78 proceeding was timely because brought within four months of the May 9, 2008 letter from the community superintendent, which reaffirmed the earlier decision to deny Kahn certification of completion of probation.

On October 28, 2009, prior to answering Kahn's amended petition, DOE moved for leave to appeal Supreme Court's decision denying its motion to dismiss. On November 23, 2009, Kahn cross- moved to amend her petition again, principally to include the committee's confidential advisory report, which had become available to her during the course of the litigation; she opposed DOE's motion for leave to appeal. On December 23, 2009, Supreme Court granted DOE's motion and Kahn's cross-motion, and stayed the proceeding until the Appellate Division handed down its decision. The judge noted that "[a]lthough the appellate courts typically do not review interim orders in Article 78 proceedings, the issues raised" -- particularly "whether the proceeding was time-barred based on [Frasier] and its progeny" -- were "significant ones which . . . merit[ed] the attention of the Appellate Division at this time."

In December 2010, the Appellate Division unanimously reversed Supreme Court's September 8, 2009 order and granted DOE's motion to dismiss the petition (79 AD3d 521 [1st Dept 2010]). While agreeing with the lower court that Kahn did not need to comply with Education Law § 3813 (1), the court concluded that her lawsuit was nonetheless barred by CPLR 217 (1) because 

"[a] petition to challenge the termination of probationary employment on substantive grounds must be brought within four months of the effective date of termination," and "[t]he time to commence such a proceeding is not extended by the . . . pursuit of administrative remedies" (id. at 522). In addition, the Appellate Division noted that while the notice of termination was procedurally defective because Kahn was not given the 60 days' prior notice required by Education Law § 2573 (1) (a), "that defect [did] not invalidate the discontinuance or render the statute of limitations inapplicable; at best, it would have entitled [Kahn] to additional back pay, had she served a notice of claim and sought money damages" (id.).

Finally, the Appellate Division concluded that Kahn did not have a valid claim under section 1983 because, as a probationary employee, she did not have a property interest in her position; the "process provided for in the collective bargaining agreement did not create" one; and she was not deprived of a liberty interest (id. at 523).
[5. Kahn does not appeal the Appellate Division's ruling with respect to her section 1983 claim.]

We subsequently granted Kahn leave to appeal (16 NY3d 709 [2011]), and now affirm.

Nash

Nash began her probationary service at DOE on September 3, 2002 in a secretarial position. After two years at Intermediate School 191, she transferred to Brooklyn Technical High School, where she was assigned to be a pupil accounting secretary. In May 2005, Brooklyn Technical's principal evaluated Nash's performance as unsatisfactory in her annual professional performance review for the 2004-2005 school year. On June 15, 2005, the principal indicated on the performance review form that he recommended discontinuance of Nash's probationary service; and on June 17, 2005, the local instructional superintendent noted likewise on the form. Additionally, on June 15, 2005 the superintendent informed Nash that on July 15, 2005, he would "review and consider whether [her] services as a probationer [should] be discontinued and [her] license terminated as of close of business July 15, 2005." He added that his consideration of termination and discontinuance was based on her unsatisfactory rating, and offered her the opportunity to submit a written response thereto no later than July 8, 2005. On June 16, 2005,
[6. That same day, Nash also filed a form to waive the one-year limitation for review of her appeal of the adverse rating she received from the principal on June 15, 2005.]

 Nash notified the Office of Appeals and Reviews that she sought section 4.3.2 review; she checked the box labeled "C-31 and Discontinuance/Denial of Completion of Probation" on the form.
[7. 7The form identified the following four choices: "U" Rating; C-31; C-31 and "U" Rating; and C-31 and Discontinuance/Denial of Completion of Probation," the option selected by Nash.]

Then on July 15, 2005, the local instructional superintendent notified Nash that "after consideration and review of all appropriate documentation," he "affirm[ed] [her] Discontinuance of Probationary Service and license termination effective close of business July 15, 2005." He further informed her that, in accordance with Chancellor's Regulation C-31 and the CBA, she had the right to appeal the decision to the Office of Appeal and Reviews within 15 school days of the date of the letter; and that her social security number would be placed on the inquiry list.

The committee held a hearing on May 10, 2006. By a vote of 3-0, the committee recommended "non-concurrence" with the decision to discontinue Nash's probationary service. On May 14, 2008, almost exactly two years later, the superintendent of Brooklyn High Schools wrote Kahn to "reaffirm[] the previous actions which resulted in Discontinuance of Probationary Service effective close of business July 18, 2005."
[8.  The date of July 18, 2005 appears to be a typographical error; there is no dispute that Nash's probationary service         ended on July 15, 2005.]

On August 13, 2008, Nash filed a notice of claim pursuant to Education Law § 3813 (1), and on September 10, 2008, she commenced this CPLR article 78 proceeding against the Board of Education and the Chancellor (collectively, DOE). In her amended petition, filed December 23, 2008, Nash alleged that DOE violated section 4.3.3 of its bylaws by furnishing her with a deficient notice of hearing, and not producing at the hearing the principal who recommended that she be let go; that DOE's alleged failure to abide by its own bylaws, Chancellor's Regulation C-31 and the CBA and to present credible evidence resulted in an arbitrary and capricious determination in violation of lawful procedure; and that DOE's failure to follow the committee's recommendation, which was supported by substantial evidence, was arbitrary and capricious. She sought an order and judgment declaring that the hearing and determination to uphold the termination of her probationary employment were arbitrary, capricious and contrary to law, and directing her reinstatement to her former position, with back pay and interest.

On January 16, 2009, DOE cross-moved to dismiss the amended petition on the grounds that Nash's claims for reinstatement and back pay were time-barred by CPLR 217 (1) because she did not sue within four months of the effective date of the termination of her probationary employment; and that insofar as she sought to review the unsatisfactory rating that she received for the 2004-2005 school year, she had not exhausted mandatory administrative and contractual remedies.
[9. DOE did not contest the timeliness of the notice of claim that Nash filed pursuant to Education Law § 3813 (1).]

In a decision, order and judgment dated October 21, 2009, Supreme Court denied Nash's petition and dismissed the proceeding as time-barred (2009 NY Slip Op 32531 [U] [NY County 2009]). Citing Frasier and Triana, the judge held that "Nash's pursuit of a review hearing and reconsideration of the discontinuance by the Chancellor's committee [did] not extend or toll the four-month statutory limitations period" in CPLR 217 (1); and that "[t]he request for review, pursuant to Bylaws § 4.3.2, [was] nothing more than a request for reconsideration of the original determination to discontinue [her] probationary employment." In Supreme Court's view and "contrary to Nash's strenuous argument, characterizing this proceeding as solely a challenge to the 2008 Chancellor's reaffirmation of the 2005 decision [did] not render timely the demands for reinstatement and back pay."

As for Nash's challenge of her unsatisfactory rating, Supreme Court concluded that she had exhausted her administrative remedies because her "request for a hearing to review a discontinuance based on a U-rating necessarily encompassed a review of that rating." But the judge found no merit in Nash's objections to the way the hearing was conducted, noting that the committee voted 3-0 in her favor.

In March 2011, the Appellate Division unanimously affirmed (82 AD3d 470 [1st Dept 2011]). The court held that to the extent that Nash disputed the loss of her job at DOE, her claim was time-barred under CPLR 217 (1) because "a petition to challenge the termination of probationary employment must be brought within four months of the effective date of termination, during which time the termination is deemed to become final and binding, and a petitioner's pursuit of administrative remedies does not toll the four-month statute of limitations" (id.). The Appellate Division further observed that "[t]he reconsideration of the matter by [the] committee did not amount to a 'fresh look' at the merits so as to renew the running of the statute of limitations" (id. at 471). Finally, the court agreed with Supreme Court that Nash's lawsuit was timely insofar as she challenged the unsatisfactory rating, and that she had exhausted her administrative remedies with respect to the rating. We subsequently granted Nash leave to appeal (17 NY3d 704 [2011]), and now affirm.

II.

The petitioner in Frasier, a probationary teacher in the New York City school system, was notified in writing by the Chancellor that his probationary appointment was terminated as of September 4, 1984. Frasier sought review of this adverse decision, utilizing the procedures established by section 5.3.4 of the Board of Educations' bylaws and the CBA. As noted earlier, this appeal process is essentially identical to the present-day section 4.3.2 review. After the review's completion, the Chancellor notified Frasier that he was reversing his earlier determination and reinstating him to probationary status.

Frasier then sought back pay and benefits for the period of time between the termination of his employment on September 4, 1984 and his subsequent reinstatement on March 25, 1985.

We framed the issue presented as "whether the Chancellor's original action terminated [Frasier's] rights as a probationary appointee under Education Law § 2573 (1) (a) as of September 4, 1984, or whether, as petitioner claims . . ., that action was nonfinal and ineffective until completion of the review procedure" (Frasier, 71 NY2d at 765). We concluded that the original action terminating Frasier' probationary employment was, in fact, final and effective and, as a result, Frasier was not entitled to back pay and benefits.

We observed that "[u]nquestionably, a Board of Education, under Education Law § 2573 (1) (a)," -- and, in New York City, the Chancellor -- "has the right to terminate the employment of a probationary teacher at any time and for any reason, unless the teacher establishes that the termination was for a constitutionally impermissible purpose, violative of a statute, or done in bad faith" (id.). Additionally, "[f]rom the language of Education Law § 2573 (1) (a), it [was] evident that a decision not to grant tenure to a probationary teacher, once made, [was] intended to be final" as "[t]he statute contains no provision for reconsideration or review or for reinstatement of a discontinued probationary appointee" (id. at 766).

We recognized, though, that a "question remain[ed]" as to "whether anything in the review procedure established in the bylaws . . . [made] the Chancellor's original decision on discontinuance nonfinal" (id. at 766-767 [internal citations omitted]). Answering this question in the negative, we concluded that the internal review procedure established in the bylaws "in no way pertain[ed] to the finality of the Chancellor's decision," but rather was "procedural only"; in short,

"[p]robationary teachers have no constitutional or statutory right to a review of the Chancellor's decisions to discontinue their services and to deny tenure. Their right to a review stems solely from the [CBA]. Section 5.3.4 [now section 4.3.2] does no more than establish an optional procedure under which a teacher may ask the Chancellor to reconsider and reverse his initial decision, a decision which is final and which, when made, in all respects terminates the employment of a probationer under Education Law § 2573 (1) (a)" (id. at 767 [internal citations omitted] [emphases added]).

Thus in Frasier, we concluded that a probationary teacher in the New York City public school system who was let go from his job but then later reinstated after completion of the optional internal review was not entitled to back pay and benefits for the period he was out of work. The principal take- away from the decision, though, is not this conclusion, but rather the reason for it; namely, that the original decision to discontinue Frasier's employment was in all respects final as of the day his probationary appointment ended and was therefore not dependent upon exhaustion of the internal review to become effective. Because a determination pursuant to Education Law § 2573 (1) (a) to discontinue a probationary employee's service becomes final and binding on that employee on his or her last day at work -- as Frasier holds -- CPLR 217 (1) dictates that any suit to challenge the determination must be commenced within four months after that date.

Petitioners understandably insist that the internal review created by the CBA and DOE's bylaws must be exhausted before suit may be brought under CPLR article 78 to challenge a determination made pursuant to Education Law § 2573 (1) (a) to discontinue a probationary employee's service. After all, otherwise their actions are untimely. But this position is not consistent with our decision in Frasier, as explained in this writing and as the First and Second Departments have repeatedly held (see also Matter of De Milio v Borghard, 55 NY2d 216 [1982] [where a probationary county employee brought a CPLR article 78 proceeding to challenge the commissioner's decision to terminate his employment, the four-month limitations period began to run from the date the employee's employment ended, not from the date when the commissioner denied his request for reconsideration of the decision to discharge him]).

Further, the ruling that petitioners seek would not, in our view, benefit probationary teachers and teaching staff generally. The grounds for overturning DOE's decision to let a probationary employee go during the probationary period are limited indeed. But under petitioners' theory, someone with a potentially meritorious claim would have to await the conclusion of the internal review -- which surely would take months and might take years -- before seeking redress in court. In the meantime, this individual would not be getting paid and, as Frasier establishes, has no right to back pay if eventually reinstated.

 Accordingly, in each case, the order of the Appellate Division should be affirmed, with costs.10

Former Teacher John Joyce Wins His Job Back At the NYC Department of Education after Retirement

When a teacher resigns from the NYC Department of Education, he/she can, supposedly, return within 5 years by requesting rescission of the resignation. However, while the UFT contract allows the return if requested before the 5-year time limit, the rules say that you must obtain approval of your return from the Chancellor as well (C-205). The Chancellor never, in my experience, gives approval of rescission. So, the UFT contract terms on returning to your job after resignation are not exactly correct. If you resign, it's irrevocable, 99% of the time.


Here is the relevant part of Chancellor's Regulation C-205:

23. Restoration of License Terminated for Failure to Meet Requirements – At the discretion of the Director and for good cause shown, a license other than a supervisory license which was terminated after August 31, 1974 for failure to satisfy full requirements may be restored when the applicant has satisfied the full requirements prescribed for the license, and has performed one school year or two school terms of satisfactory regular substitute or appointed service in the field of the license.

24. Dismissal for Cause, Resignation or Retirement While Charges Are Pending - This subdivision applies to persons who were dismissed pursuant to Section 3020a of the New York State Education Law or who resigned or retired while such charges were pending. All licenses and/or certificates held by such a person at the time of separation from service shall terminate permanently. No such person shall be eligible to apply for any new license or certificate, nor for reemployment by any unit of the City District or of any community school district without the recommendation of the Executive Director of the Division of Human Resources and the express written authorization of the Chancellor.

25. Discontinuance of Probationary Service or Denial of Completion of Probation – This subdivision applies to persons whose services have been discontinued during the probationary term or who have been denied completion of probation but in no way applies to those persons covered by Subdivision 24 above. Although either action results in the dismissal of the employee, neither discontinuance of probationary service nor denial of completion of probation results in termination of the individual’s license.
a. When a determination to discontinue probationary service or to deny completion of probation is reversed before actual termination of services, the employee continues to serve without interruption and there is no change in status.
b. After discontinuance of probationary service or denial of completion of probation, a non-supervisory pedagogical employee retains the license and may, upon application, be granted a certificate valid for substitute service. This certificate is valid as long as service is satisfactory and the holder indicates continuing availability for service.
c. A district other than the one which discontinued the services of a probationer or denied completion of probation may reappoint the probationer to a new probationary term although the possibility of such appointment does not convey any right to such consideration. Such appointments shall be limited to those where the minimum probationary period is no less than two full school terms or one full school year. For the purpose of determining the length of the new probationary term, each full term of service rated satisfactory under the former appointment exclusive of any period of less than a full school term shall be considered equivalent to a term of regular substitute service. For purposes of determining status in other respects, any period of non-service between termination by the first district and appointment by the second shall be considered equivalent to a leave of absence granted without right of return to prior position, without pay and without service credit for retirement.

Note: Since for this purpose, the schools operated under the jurisdiction of the Chancellor and Central Board comprise one district, persons whose probationary service was discontinued in one school in the City District may not be reappointed under the same license to another school in the City District. This is true even if the dismissal occurred from one “high school district” and the dismissed employee sought employment in a different “high school district.” Those discontinued by one Community District, however, may be appointed to a new probationary term by another Community District. Similarly, a teacher who was discontinued or denied completion of probation in a high school under central jurisdiction might be appointed to a new probationary term for service in a high school under Community District jurisdiction.

d. A dismissed probationer who previously served satisfactorily under another regular license, may request reassignment under the other license. Upon receipt of such written request by the Executive Director of the Division of Human Resources, the affected employee shall be assigned to the first appropriate vacancy. For determination of status, the period of non-service between dismissal and reassignment shall be considered equivalent to a leave of absence granted without pay, without the right of return and without service credit for retirement. A dismissed probationer who was previously tenured under another regular license shall be returned forthwith to an appropriate position.

26. Resignation - Except in the case of resignation to return to a former position, the resignation by a member of the teaching and supervising staff shall be deemed to be a resignation from the pedagogical service of the public school system. Thereafter, upon application, the resigned employee may be issued a certificate valid for substitute service so long as service is satisfactory and the holder indicates his or her availability for continuing service. Resignations shall be submitted in writing and, once submitted by an employee, shall be considered final. However, if there has been no break in actual service, the appointing authority may, in its discretion, permit the employee to rescind the resignation before its effective date.
a. Required Notice of Resignation
A pedagogical employee who desires to resign is required to submit written notice to the principal or equivalent organizational unit head at least thirty calendar days prior to the date on which the resignation is to take effect. (See Section 3019a of the Education Law.) Failure to submit timely notice shall preclude subsequent restoration of the license or the issuance of a substitute certificate without the specific, written authorization of the Executive Director of the Division of Human Resources.
b. Absence Without Notice
As provided by contractual agreements, any pedagogical employee who is absent without notice for twenty or more consecutive school or work days is deemed to have resigned as of the first day of such absence. Notwithstanding any other regulation, withdrawal of such a resignation may not be permitted without express written authorization by the Chancellor.

27. Return to Former Position from Present Position - Provided Section 24 of this Regulation does not apply, a person who is serving under regular license and appointment may request reassignment to a vacancy in a non-supervisory grade or salary level in which the employee served satisfactorily for at least one year or two full school terms and for which the employee was previously granted a valid license. After a receipt of such a written request, the Executive Director of the Division of Human Resources shall assign the employee to the first appropriate vacancy in the former title. In such cases, the employee shall be deemed to have resigned from his or her present position. Salary upon resumption of service in the former position shall be fixed as if all appointed service had been performed in the position to which the employee is returned. An employee who has resigned and had been returned to a former position in this manner may be permitted to withdraw such resignation in accordance with the general rules set forth in Subdivision 28 below.

28. Withdrawal of Resignation Generally – Except for persons covered by Section 24 or subdivision 26b of this Regulation, upon written request, a pedagogical employee who has resigned may, at the discretion of the Executive Director of the Division of Human Resources, be permitted to withdraw such resignation for the purpose of reinstatement to service, regardless of whether the person was tenured or not on the date of his or her resignation, if:
a. at the time of resignation, the individual had completed at least one year (or two full school terms) of satisfactory, regularly appointed service under the license; and
b. the license has not been invalidated and is not subject to invalidation for failure to satisfy requirements. If the employee was untenured at the time of resignation, a three year probationary period will be required.

29. Withdrawal of Resignation Within Five Years by Tenured Staff – Except for persons covered by Section 24 or subdivision 26b of this Regulation, a non-supervisory pedagogical employee who had attained permanent tenure prior to the date of resignation shall, remain tenured and, upon written request, be permitted to withdraw such resignation subject only to medical examination and the approval of the Chancellor, provided that reinstatement is made on or before the opening of school in September next following five years after the effective date of resignation. If reinstatement is made after this date, a two year probationary period will be required.

30. Substitute Service Following Resignation – Except for persons covered by Section 24 of this Regulation, a resigned employee may perform substitute service after resignation as follows:
a. Substitute service may be performed in any field for which the resigned employee holds a certificate or license valid for substitute service.
b. A resigned employee who does not hold a valid substitute credential but who met the minimum preparation requirements for licensure, may request issuance of a substitute certificate valid for substitute service in the field of any license held at resignation. After receipt of the applicant’s written request by the Executive Director of the Division of Human Resources, the applicant may be issued such a certificate valid so long as service is satisfactory and the holder indicates continued availability for service.

31. Retirement and Reinstatement – Except for persons covered by Section 24 of this Regulation, a pedagogical employee who desires to retire shall submit written notice to the principal or equivalent organizational unit head at least thirty calendar days prior to the effective date of retirement. (See Section 3019a of the Education Law.) Failure to submit such timely notice shall preclude subsequent restoration of the license, reinstatement to service or the issuance of a certificate valid for substitute service without the specific written authorization of the Executive Director of the Division of Human Resources.

32. Substitute Service Following Retirement – Except for persons covered by Section 24 of this Regulation, a retired employee may perform substitute service after resignation as follows:
a. Substitute service may be performed in any field for which the retired employee holds a valid substitute credential.
b. A retired employee who does not hold a valid substitute credential but who met the minimum preparation requirements for licensure, will be issued a certificate valid for substitute service in the field of any license held at retirement. After receipt of the applicant’s written request by the Executive Director of the Division of Human Resources, the applicant may be issued such a certificate valid so long as service is satisfactory and the holder indicates continued availability for service.

Note: Paid employment by the Board of Education is subject to the income limitations imposed upon retirees by Sections 211 or 212 of the New York State Retirement and Social Security Law. Any retiree contemplating employment by a New York City or New York State Agency which may generate substantial income must consult with the retirement system of which the retiree is a member to ensure compliance with the law. Failure to do so may result in interruption or reduction of the retirement allowance which the retiree normally receives.

33. Reinstatement to Active Service Following Retirement – Except for persons covered by Section 24 of this Regulation, a retired pedagogical employee may, at the discretion of the Executive Director of the Division of Human Resources and after written request, be permitted to terminate retirement if:
a. at the time of retirement, the individual had completed at least one year (or two full school terms) of satisfactory regularly appointed service in the license under which service is to resume;
b. the license has not been invalidated and is not subject to invalidation for failure to satisfy academic and professional requirements;
c. the requirements and procedures specified for such cases by the Retirement System of which the applicant is a member shall have been complied with; and
d. the retired pedagogical employee who is permitted to terminate retirement and is reinstated to service shall serve a new probationary term for three years.

34. Involuntary Termination of Disability Retirement – The status of a person who has been retired for disability is subject to review from time to time by the retirement system of which the individual is a member. Upon determination by the retirement system that the person is free of disability or, in the case of accidental disability retirement, is no longer disabled as the result of an accidental injury sustained in the line of duty, the retirement system may order termination of retirement without the consent of the affected individual. After receipt of notice that disability or accidental disability retirement is to be terminated, the former employee shall be assigned to an appropriate vacancy. Generally, such reinstatement is effected no later than the opening of schools in the September following receipt of notice from the retirement system.

Tenured social studies teacher John Joyce was lucky.

 On or about August 30, 2011, petitioner resigned his employment as a tenured social studies teacher with respondent New York City Department of Education (DOE). Less than a year later, on or about July 29, 2012, he submitted a request to DOE to rescind his resignation pursuant to Chancellor's Regulation C-205(29). Following an almost 4-year delay by respondents in acting on petitioner's request, and litigation between the parties, and only after petitioner filed a motion for contempt, did respondent Chancellor finally respond to and deny the request. In her letter of June 21, 2016, the Chancellor cited petitioner's unsatisfactory year-end performance rating for the 2010-2011 academic year, a determination that was ultimately annulled by this Court by decision dated May 10, 2018 (see Matter of Joyce v City of New York, 161 AD3d 488 [1st Dept 2018])

John won his case because the Judges asked, how come the Department waited 4 years to answer Mr. Joyce's request to return to the Department? Can't do that, they ruled:

Judgment, Supreme Court, New York County (Manuel J. Mendez, J.), entered April 5, 2017, to the extent appealed from as limited by the briefs, vacating respondents' determination, dated June 21, 2016, which denied petitioner's request for rescission of resignation, and directing respondents to accept petitioner's request, unanimously affirmed, without costs.
On or about August 30, 2011, petitioner resigned his employment as a tenured social studies teacher with respondent New York City Department of Education (DOE). Less than a year later, on or about July 29, 2012, he submitted a request to DOE to rescind his resignation pursuant to Chancellor's Regulation C-205(29). Following an almost 4-year delay by respondents in acting on petitioner's request, and litigation between the parties, and only after petitioner filed a motion for contempt, did respondent Chancellor finally respond to and deny the request. In her letter of June 21, 2016, the Chancellor cited petitioner's unsatisfactory year-end performance rating for the 2010-2011 academic year, a determination that was ultimately annulled by this Court by decision dated May 10, 2018 (see Matter of Joyce v City of New York, 161 AD3d 488 [1st Dept 2018]).
We find that good faith and fairness demand that a decision on a request for rescission of resignation pursuant to Chancellor's Regulation C-205(29) be made within a reasonable time. We reject respondents' suggestion that the Chancellor has the discretion to wait more than three years before making such a decision, without providing a reason for the delay. Supreme Court had directed DOE, in an order issued May 6, 2013, to follow its own stated procedure by accepting the rescission letter and reinstating petitioner (subject only to the Chancellor's approval, pursuant to the regulation). Respondents' delay was unacceptably long and effectively operated to subvert the court's order.

I believe that the resignation of a teacher for any reason, and the subsequent rule that anyone in good standing still must get the approval of the Chancellor in order to get employment at the Department once again is constructive termination:


"What is constructive discharge? Constructive discharge occurs when an   employee is forced to quit because the employer has made working conditions unbearable. Unbearable conditions include discrimination or harassment, mistreatment, or receiving a negative change in pay or work for reasons that are not work-related. An employer who harasses an employee in order to get them to resign as opposed to firing them is one attempting a constructive discharge."
