NEW YORK, NY - New York City Comptroller John C. Liu (pictured above with his family) stated the following in response to questions about the Department of Education's (DOE's) withdrawal of its "Blanket Approval of Purchases through Contracts" Resolution from tonight's Panel for Educational Policy (PEP) meeting agenda:

"The DOE did the right thing by pulling this Resolution. Contracting is not always easy but still must be done the right way, especially when it’s State law. My office looks forward to working with the DOE and the conscientious New Yorkers serving on the PEP to advance the best interests of our schoolkids."

DOE removed the Resolution from tonight’s PEP agenda after Comptroller Liu asked PEP members to reject it, arguing that the Resolution would run counter to the intent of school governance reform passed by the State legislature just last August.

Attached below are Comptroller Liu’s July 16th letter to the PEP and yesterday’s statements by Comptroller Liu, City Council Education Committee Chairperson Councilmember Robert Jackson, and State Asssemblymember Micah Kellner.

DOE WANTS BLANK CHECK FOR CONTRACTS; LIU URGES NO!

NEW YORK, NY - New York City Comptroller John C. Liu urged the Panel for Education Policy (PEP) to reject the Department of Education (DOE) resolution for a "Blanket Approval of Purchases through Contracts", which would allow the DOE to make contract purchases without PEP approval. The DOE resolution, on the meeting agenda posted for the upcoming July 19 PEP meeting, comes less than a year after PEP approval of contracts became required in the school governance reform (widely known as the extension and modification of mayoral control of New York City schools) passed by the state legislature last August.

During the heightened public debate leading up to the legislative passage, New York State Comptroller Thomas DiNapoli had issued an audit report which found significantly diminished assurance that the DOE's non-competitive contracts were justified.

Comptroller Liu stated: “It's rather amazing that the DOE is already plotting an end-run around the stronger DOE accountability required by school governance reform

passed less than a year ago. The State legislation answered public demands for greater scrutiny and oversight of the DOE, yet the DOE just doesn't relent in its pursuit of less public scrutiny and less oversight. This little-known resolution, if passed, will not only circumvent State law, but will encourage more expensive and unnecessary contracts, many of which will undoubtedly be no-bid contracts that the public clearly disapproves of."

New York City Councilmember and Education Committee Chairperson ROBERT JACKSON stated: "Comptroller Liu's letter should be required reading in Albany. Each and every one of our State legislators needs to understand how their intent is being averted by DOE's attempt to bypass the explicit protocol they established to foster accountability and public scrutiny. This violates State law by removing PEP oversight, but the stealth bomber under the radar approach of presenting this speaks volumes about DOE lack of respect for public discourse and disclosure."

Assemblymember MICAH KELLNER stated: “This resolution is a clear attempt to circumvent the contracting oversight provisions included in the school governance reforms that were passed by the legislature last summer. By putting forward this resolution the Department of Education is showing that they want to pick and choose which parts of the law they want to comply with. That is not how the law works.”

In his July 16 letter to the PEP urging rejection of the resolution, Comptroller Liu also noted that the resolution was not properly disseminated for review prior to the vote and is inconsistent with existing procurement policies and procedures. Although the vote on the resolution is listed on the PEP's meeting agenda for tomorrow, July 19 (http://schools.nyc.gov/NR/rdonlyres/E771A08A-C2EC-463F-A186-473FE1AAFF63/85721/PEP_RevisedAgenda_Jul192010.pdf), the resolution itself is still nowhere to be found nor provided. Dear Mr. Chang and Mr. Hernandez:

On Monday, July 19, 2009, the Panel for Educational Policy ("PEP") will be asked to approve a resolution entitled “Blanket Approval of Purchases through Contracts of the City of New York and its Agencies” amending Section 2-08(d)(2) of the Department of Education’s (“DOE”) Procurement Policy and Procedures to permit DOE to make purchases through contracts of the City of New York and its agencies without PEP approval. Presently, contracts with the City of New York and its agencies require approval by the PEP in conformance with New York State Education Law Section 2590-g(5)(c). I write to inform you of the need for your continued oversight and to urge you to reject the resolution as it is imprudent, inconsistent with existing state law and would perpetuate DOE’s history of poor transparency and accountability.

My office has repeatedly asked for copies of the resolution, and to date, a copy of the resolution has not been provided. But it is our understanding that the resolution seeks to amend Section 2-08(d)(2) of the DOE’s Procurement Policy and Procedures as approved by PEP on January 27, 2010 to exempt any contracts from PEP approval by the City of New York and its agencies as undertaken by the DOE. Section 2-08(d)(2) currently exempts only contracts with the U.S. General Services Administration and other federal agencies or those with the NYS Office of General Services and other State agencies from PEP approval. However, DOE has no authority to amend its Procurement Policy and Procedures when such amendment would be inconsistent with the provisions of New York State Education Law as amended on August 11, 2009.

It has been less than a year since the New York State Legislature strengthened the PEP’s authority over DOE’s contracting process because it, in its wisdom, believed that it was prudent to require greater oversight and public transparency over what amounts to billions of dollars in taxpayer expenditures each year. My office takes the same position. Public transparency is our duty. Blanket approval of contracts with City agencies effectively removes these contracts from the PEP and public scrutiny. Had the State Legislature intended to exempt these contracts from the PEP approval, as it elected to do with New York State and federal contracts, it would have done so.

Presently, the City of New York conducts procurements, known as “requirements contracts,” that are structured to serve multiple agencies. Such contracts are generally let for goods and/or services concerning information technology and commodities purchases through contracts held by the Department of Information Technology & Telecommunications (DOITT) and the Department of Citywide Administrative Services (DCAS). Requirements contracts were established to achieve economies of scale and are limited to the above two agencies. Although my office has been informed that DOE intends to purchase from only DOITT and DCAS requirements contracts, it is my understanding that the proposed resolution provides for no limitations on the exemption.

Additionally, I must point out that it is unclear whether DOE has complied with applicable PEP by-laws concerning public review. Section 2.5.1(g) of the PEP by-laws states that the PEP shall undertake a public review process “prior to approving a procurement policy for the City District and any amendments made thereto;….The public review process shall include notice of the proposed item under PEP consideration at least 45 days in advance of the Panel vote on such item. Such public notice shall include a description of the subject and the purpose and substance of the proposed item under consideration, and shall otherwise conform to the requirements of Education Law 2590-g(8) (a).” Based upon a review by my office, such required public notice does not appear to have been properly posted on the PEP website, as required, nor has such notice been properly provided in conformance with the Education Law. My office discovered this item on July 2, 2010 under the “Public Meetings” and “Agenda” section of the website rather than under the “Public Notice” section. Additionally, the date of the Agenda page changes automatically, thus there is no way of knowing when, in fact, the item was posted and whether the 45 day requirement was met. Moreover, the website contains no information under the “Meeting Materials” section nor the does the Agenda item itself describe with any detail what could remotely be interpreted as the “purpose and substance” of the proposed item.

In light of the fact that 30 percent of the City’s budget is spent on education, our City’s taxpayers need more accountability on school spending and the PEP should not allow DOE to maneuver an end run around governance reform that was passed less than a year ago and to do so in a manner that appears calculated to deceive the public.

I strongly urge you to reject the resolution.

Education Panel Delays Vote to Weaken Its Own Authority

Updated, 6:00 p.m. | The Panel for Educational Policy, the successor to the old Board of Education, is controlled by appointees of the mayor, so it summarily approves just about everything that comes before it. But has the city quietly been trying to make a near-toothless panel even less relevant?

The Panel for Educational Policy votes to close one of 19 schools slated for phase-out by the DOE, as school supporters look on.
That is the accusation of John C. Liu, the city comptroller, and Patrick Sullivan, a panel member not appointed by the mayor, in reaction to a resolution that had been on the agenda for the panel’s July meeting on Monday night, but was removed on Sunday amid their questions.

The resolution, called “Blanket Approval of Purchases Through Contracts of the City of New York and Its Agencies,” asked the panel to weaken one aspect of a power it was granted last year under the mayoral control law, its ability to approve or veto all contracts that are not competitively bid.

Right now, state law gives the city’s Department of Education blanket authority to approve purchases of items made under existing state and federal contracts, provided the price of those items is “below the prevailing market rate.” In other words, if a state agency has already worked out a good bulk price on computers, the city Department of Education can buy computers under that contract without the panel’s approval.

But that authority does not extend to contracts made by other city agencies, and the panel must vote on purchases made under those contracts. The resolution would change that.

In a statement, Mr. Liu said the resolution would amount to “an end-run around the stronger D.O.E. accountability required by school governance reform passed less than a year ago,” which he said would “circumvent state law.”

Neither he nor Mr. Sullivan had received a copy of the resolution by Sunday, though Mr. Sullivan was supposed to vote on it the next day, and it did not appear on the Department of Education’s Web site.

“I asked specifically about whether this was in compliance with the law,” Mr. Sullivan said, “and I expressed concern that the D.O.E. was asking the panel to expand its authority in contravention of the law. And they didn’t respond.”

The city said Monday that the authority the panel was seeking had already been approved by the panel in principle, in a few lines tucked into a 103-page procurement document passed at the panel’s January meeting. That was also the night that thousands of people attended to protest school closings and there was little public debate on procurement rules.

“I think we missed it,” Mr. Sullivan said. “I think the panel made a mistake.”

The city said it expected the issue to return to the agenda in August, after the panel’s questions about the resolution were answered. Update: A Department of Education spokesman, Jack Zarin-Rosenfeld, said later Monday afternoon that the fate of the resolution was unclear and that it would be worked out with the panel members.

The resolution would affect only purchases by schools or the central office with an annual value of less than $25,000. A central contract office would still manage the process.

“This proposal would let D.O.E. and schools take advantage of city contracts that have already been properly negotiated and are below market price, saving both time and money,” said Mr. Zarin-Rosenfeld.

What has California got to do with New York State? Alot. The earth is a very small planet, and the United States is a smaller part of this small world. With the internet, what happens anywhere can be read/experienced instantaneously by anyone, anywhere there is an internet connection.

We can see below that our federal money will now be given to Charter Schools. I hope everyone recognizes that this is part of the process known as "de-public-ing schools" perpetrated by a select few who work within the education-political-complex ("EPC"). The EPC uses the following tactics in pursuit of their Agenda:

1. removal from public education of Labor Unions by getting rid of teacher tenure and other benefits;

2. destruction of curriculum by hiring non-educators as Chancellors/Administrators, who force unworkable standards and dumbed-down testing on school staff in order to close public schools and replace with schools directly and totally under their control;

3. give immunity to anyone who will lie, cheat or steal public money in support of the non-public goals cited by school leaders; this makes all staff beholden to The System (especially important during times of economic downturn where high levels of fear of unemployment stop people from whistleblowing the actions of anyone) by establishing a dual-level hierarchy for accountability. If the principal commits a crime or acts in a way that is not appropriate, you will be removed from your job if you tell on him/her, and if anyone finds out about the misconduct you will be found guilty of doing it or sustaining the crime (either way, you lose);

4. establish terror in the workplace so that no one speaks to anyone about anything that happens in a school;

5. hire beholden former cops as "investigators" to substantiate false claims against targetted individuals (this is the reason why Mayor Mike Bloomberg changed the Special Commissioner's position - formerly open to only an Attorney - in 2002 from the required Attorney to a non-Attorney, Richard Condon, who is a long-time family friend of Rose Gill Hearn at the Department of Investigation);

6. run out of town anyone who is exposed by the media or super snoops as involved in the EPC, get him/her hired in another state for more money or at least enough money to remain silent about the EPC.

State Schools Chief Jack O’Connell Announces California
Is Awarded Federal Charter Schools Grant


SACRAMENTO – State Superintendent of Public Instruction Jack O’Connell today announced the California Department of Education (CDE) was awarded a major federal Charter Schools Program grant through the U.S. Department of Education’s Office of Innovation and Improvement. California applied for $300 million in federal Charter School start up grant funds. The U.S. Department of Education has not yet announced the amount California will receive from this competitive grant program.

“High quality charter schools can spur innovation and provide communities more flexibility to create the kind of learning environment they want for their children,” said O’Connell. “This infusion of federal funding will give a boost to communities trying to initiate and share information about a charter school, so the organizers can focus their attention on helping students succeed academically.”

California's federal charter grant application specifies that the state will use the federal funds to increase the number of high quality charter schools in the state with stronger fiscal, governance and academic accountability training and reporting requirements. The funds are also intended to sustain charter schools' capacity to improve the academic achievement of students and support the dissemination of effective practices of high quality charter schools. Preference will be given in the distribution of the funds to assist the development of high quality charter schools located in high need communities where students attend schools in Program Improvement.

O’Connell has long been a supporter of high-quality charter schools that can serve as laboratories of education innovation. A charter school is a public school that usually is created or organized by a group of teachers, parents, and community leaders or by community-based organizations. A charter school may be sponsored by an existing local public school district governing board or county board of education.

Charter schools are generally exempt from most laws governing school districts, except where noted by law. In exchange for this increased flexibility, charter schools are held accountable for improving student academic achievement. The objective is to replace rules-based governance with performance-based accountability, thereby stimulating the creativity and commitment of teachers, parents, and citizens.

The federal Charter Schools Program funding is designed to help communities in the planning, program design, initial implementation, and dissemination of information on charter schools. As the grantee, the CDE will make the funding available as subgrants on a competitive basis to developers of charter schools who have applied for a charter. Charter schools will be able to apply for the subgrant funding once federal review of several requested waivers is complete, and the Legislature has approved a budget and the disbursement of the funds.

Once an applicant is awarded a subgrant through the CDE, the funding may be used for the planning and design of the education program for a charter school, refining the desired education results, refining methods for measuring progress toward achieving those results, and the initial implementation of the charter school. Implementation may include informing the community about the charter school and acquiring necessary equipment, materials, and supplies.

The CDE may reserve up to 10 percent of the grant for another subgrant to share lessons learned from high-quality charter schools with a demonstrated history of success. The purpose would be to share information about how to create and sustain high-quality, accountable schools with other public schools and charter schools.
